Every case has a frame. If you don’t choose it, jurors will choose it for you. This talk is about purposeful framing using focus groups and large-scale juror data studies. Focus groups tell you why—why do jurors feel the way they do? What shifts blame? Which defense argument are you failing to overcome? Big data studies tell you statistically what matters—which case facts move damages, which juror characteristics predict a defense verdict, what is the case worth, what is the best “ask,” and how do variables shift the verdict outcome?

Jessica Brylo will work through real case examples to demonstrate how to uncover a persuasive frame and how these tools can be properly used to increase your chances of winning and find the value of your case. Along the way, she will explain how to read findings, what to be skeptical of, and how to implement findings into your trial strategy. Attendees will leave with a clear sense of what to test, when to test it, and how to apply what you learn in the courtroom.
