Description

The law on AI use in litigation is rapidly changing, and plaintiffs’ lawyers need to be prepared going into 2027. Recent decisions have been issued addressing expert discovery, the discoverability of clients’ AI chats, and the reach of privilege and work product. States and individual courts are taking different approaches to AI disclosure, while new confidentiality requirements (including California Senate Bill 574) raise practical questions about where lawyers can safely put client information.

Join trial attorney Nathan Gaffney in a 90-minute AI-focused CLE that will cover:

  • The Foundation:
    •  Competence and professional judgment—what competent AI use requires of trial lawyers, including exercising independent judgment, supervising the work, and maintaining command of the final product.
  • AI and Expert Witnesses:
    • The new cases addressing discovery of expert prompts and AI outputs (Villanueva v. LVMPD and Conservation Law Foundation v. Shell)
    • Managing your own expert’s AI use
    • Pursuing discovery and preparing cross-examination when you suspect an opposing expert used AI to develop opinions or draft a report (E.G. v. Continental)
    • Experts excluded or impeached over AI-generated content (Kohls v. Ellison, Concord v. Anthropic, In re Celsius, and others)
  • Privilege and Work Product for AI Chats:
    • When privilege and work product may protect AI chats by clients, unrepresented litigants, and lawyers themselves (U.S. v. Heppner and Whisman v. Rajabi)
    • When those materials may be discoverable
    • Practical steps to preserve applicable protections
  • AI Disclosure, Confidentiality, and Platform Selection:
    • State and court requirements governing AI disclosure, including California’s new disclosure and confidentiality requirements (California SB 574 effective. Jan. 1, 2027 vs. New York, Illinois, and Florida)
    • Evaluating platform security before uploading client information
    • Choosing among newer frontier models and affordable plans for particular legal workflows, including alternatives to specialized legal AI platforms
  • Firm Supervision, AI Policies, and Client Consent:
    • Supervising AI use by lawyers and staff, developing firm AI policies, and addressing client informed consent, including when it is needed—sample policies and consent forms will be provided.
  • Writing and Verification:
    • Using AI to draft routine matters and motions;
    • Writing for deeper understanding and retention when preparing to argue in court
    • Demonstrating a repeatable method for checking facts, quotations, and citations against original sources before filing
