Ensuring patients have access to the treatment they need, whether it’s to return to their pre-injury status or maximize their post-injury quality of life, is a key factor in optimizing personal injury outcomes. Insurers, however, want to end cases as quickly as possible and spend as little as possible. So how do doctors get what their patients need?
They must understand the claims process.
Over 90 percent of all auto cases in the United States are evaluated using bodily injury assessment software. A high percentage of premises liability and workers’ compensation claims are also evaluated using the same programs. These programs (Colossus, Claims Outcome Advisor, ClaimIQ, and others) aim to save insurers money, and provide settlement offers based on set factors.
A generation of insurance adjustors have now been trained to look for specific factors in cases; and there have even been instances when the use of these software systems has been concealed from injured people, their doctors, and their lawyers, including misrepresentation that the programs are not or are no longer used. Whenever you treat an injured person making an insurance or legal claim, your records become the most important part of the claim file and can significantly impact litigation if their case does not settle.
By understanding the terminology and factors that bodily injury assessment software use, you can better prepare your records to both accurately reflect your patient’s injuries for an objective evaluation of their claim and to stand up to the scrutiny of an insurance company or jury.
Understanding your role as a treating doctor or expert witness in the litigation process from beginning to end will further help you make certain your patients’ needs are met. There are many issues that face doctors providing personal injury care, including:
- How do I get paid? We will also discuss general concepts of Personal Injury Protection, MedPay, Letters of Protection, Liens and how each of these could impact the patient’s case.
- What is the algorithm for medical bill review software and services? What will be considered in determining if your care is “reasonable and necessary”?
- What do you need to know about specialty cases, including trucking, rideshare, delivery vehicle, minor impact cases, and more?
- How does insurance coverage stack? In serious injury cases, it is important for the patient to consider whether there may be additional sources of insurance coverage. This can include multiple PIP or MedPay policies, stacking liability coverage, uninsured motorist claims, and underinsured motorist claims.
- What uncommon injuries do you need to look for in traumatic injury cases?
- How do you write the best quality narrative report for a personal injury case?
- Should you refer and under what circumstances?
- When is an AMA Permanent Impairment examination warranted?

DeShaw is also a retired doctor and author of several books on insurance claim practices including his landmark books on Colossus.

Refund Policy: Cancellation for seminars and webinars 7 days or more prior to the event will receive a partial refund. Cancellations 30 days prior to the event will given a 90% refund, cancellations 7-30 days prior will be given a 50% refund. No refunds will be given for cancellations in the week prior to the event.
