Many of the best trial lawyers teach “exclusionary” jury selection: identifying and eliminating bad jurors for cause. Other great trial lawyers preach “inclusionary” jury selection: replacing the focus on getting cause challenges with persuading jurors to rally around shared values (sometimes called “building a tribe”).
Do you have to choose one method or the other? If you make your worst jurors feel comfortable admitting their biases, won’t it be difficult—or worse, appear disingenuous—to turn around and persuade your best jurors that they can be fair despite their sympathetic leanings? If you first persuade your best jurors that their strong feelings aren’t biases, won’t that convince your worst jurors that their negative leanings aren’t biases either?
Jury consultant Harry Plotkin will teach you how to explain bias in a way that allows you to convince your best jurors that they can fairly judge the defendant, and your worst jurors that they’re biased. The secret starts with how you think about bias and ends in how you frame (explain) what bias is and isn’t during voir dire.
During this webinar, Plotkin will also teach you how to stop getting rid of jurors who may think they’re biased against you, but are actually receptive to your case. You will learn how voir dire can be carelessly used to get good jurors to think they’re biased against you and off for cause, and how to be careful about pushing back when jurors mistake misunderstandings with bias. Plotkin will also cover situations where peremptory challenges are banned or limited in scope. By the end, you’ll learn to identify jurors who are capable of being outraged and holding defendants fully accountable.
